Drive with Mwakete — Driver Agreement
1. What this agreement is
Mwakete is an online marketplace. It lets sellers book a driver to deliver an order within one island. You are an independent driver: you work for yourself, not as an employee, worker or agent of Mwakete. You choose when you are online and which jobs you take. You do not receive a wage, and you may also work for others.
2. Who can drive
- You are 18 or older and have the right to work in Kiribati.
- You hold any licence the law requires for your vehicle, and your vehicle is registered (where required), safe and roadworthy.
- You give Mwakete one true ID — your KPF ID, National ID, passport or driver’s licence — and take the face check in the app. The face check compares your face with your ID photo. Mwakete may also check your documents by hand.
- Mwakete may approve or refuse an application, and will tell you its decision on Facebook Messenger (and by email).
3. Jobs and fees
- Jobs are offered only on your island, from a store to a buyer on that same island. You are free to accept or ignore any job.
- You set your own fee. For each job you and the seller agree the delivery fee in the job chat. Either of you may propose a fee; once you both agree, it is fixed and cannot change.
- The seller pays the agreed fee to Mwakete. Mwakete holds it for you and credits it to your Mwakete balance after the buyer confirms delivery and a short waiting period (currently 48 hours). You may ask for payment once your balance reaches the minimum (currently $20); Mwakete pays you by bank transfer to the account you give.
- Mwakete currently takes no commission. Mwakete will give you at least 30 days’ notice before any commission or charge starts.
- You pay your own costs — fuel, phone, repairs, licences and insurance — and you are responsible for your own tax and other legal obligations.
- If a delivery fails or is disputed, the fee is decided as set out in the Terms of Service, and a Mwakete administrator may make the final decision.
4. Doing the job
- Collect the goods only when the app tells you the job is ready, and take care of them until they are delivered.
- Record the pickup and the delivery honestly in the app, with the required photo and the name of the person who received it. Never open, swap or keep any part of an order.
- Do not ask the buyer or seller for extra money beyond the agreed fee.
- Share your live location only while you are on an active job. You can switch it off at any time.
5. Safety and conduct
- Follow the road laws. Never drive under the influence of alcohol or drugs, or while unfit to drive.
- Be polite and respectful. Harassment, threats, discrimination or dishonesty toward buyers, sellers or Mwakete staff are not allowed.
- Tell Mwakete straight away (through Help & support) about any accident, injury, theft, loss or damage during a job.
- You are responsible for loss of or damage to goods that is caused by your own carelessness or dishonesty, and for your own vehicle, injuries and insurance.
6. Privacy
- A buyer’s name, phone number and address are given to you only for the job you accepted. Use them only for that delivery, never share them, and do not keep them afterwards.
- Mwakete uses your ID photo, face-check photo and this signed agreement only to check who you are and to manage your account. They are stored privately, seen only by Mwakete administrators, and deleted 90 days after you are refused or stop driving (see the Privacy Policy).
7. Suspension and ending
- You may stop driving at any time by going offline and telling Mwakete.
- Mwakete may suspend or end your access if you break this agreement or the Terms of Service, if there are serious or repeated complaints, or if your identity cannot be confirmed. Mwakete will tell you why.
- Any balance owed to you is paid after open jobs are settled, as in section 3.
8. Responsibility
To the extent the law of Kiribati allows, Mwakete is not responsible for your vehicle, your costs, any injury to you, or any loss caused by your own actions; and you agree to cover Mwakete’s reasonable losses caused by your breach of this agreement. Nothing in this agreement removes rights you have under the law.
9. Changes and law
Mwakete may update this agreement. It will tell you on Messenger or by email at least 14 days before a change takes effect; if you keep driving after that, the new version applies. This agreement is governed by the law of Kiribati. It works together with the Mwakete Terms of Service; if they disagree on a driver matter, this agreement applies.
10. Signatures
By signing, you confirm that the details you gave are true and that you have read and agree to this agreement.
